Terms & Conditions

These Terms and Conditions (“Terms”) govern the provision of creative services by Creative Aim Media (“we,” “us,” or “our”), a boutique creative agency owned and operated by Amy Vargas and based in Mount Airy, North Carolina, USA. By requesting a quote, approving a proposal, making any payment, or otherwise engaging our services, you (“Client,” “you”) agree to be bound by these Terms.

1. Services We provide creative services including promotional videos, TV/radio commercials, video production & editing, motion design & animation, strategic branding & identity packages, presentation design, professional photography, photobooth rental, social media content & UGC, aerial drone cinematography & footage, and bilingual (English/Spanish) materials. Services are delivered remotely nationwide, with in-person options (shoots, reviews, photobooth setups) available within 20 miles of Mount Airy, NC.

2. Proposals, Quotes & Acceptance Quotes and proposals are valid for 30 days unless stated otherwise. Acceptance occurs upon written approval (email is sufficient) and payment of the initial deposit (typically 50% unless otherwise specified). Work begins only after deposit receipt.

3. Payment Terms

Deposits are non-refundable once work has commenced.
The remaining balance is due upon final delivery or as scheduled in the proposal.
Late payments accrue interest at 1.5% per month after 10 days past due.
Accepted payment methods: bank transfer, credit card, PayPal, check (all in USD).
Additional revisions beyond the agreed scope (normally up to two rounds of minor revisions) are billed at our standard hourly rate ($65–$150/hour depending on service).
Client is responsible for third-party costs (stock footage, music licenses, printing, travel beyond 20 miles, etc.) unless pre-approved in writing.

4. Intellectual Property & Usage Rights Upon full payment, we grant you a non-exclusive, worldwide, perpetual, royalty-free license to use the final deliverables for your internal business purposes. We retain ownership of all original source files, raw footage, preliminary concepts, and proprietary tools unless otherwise agreed in writing. We may include the work in our portfolio, website, social media, or promotional materials (with credit where possible) unless you request confidentiality in writing at project outset.

5. Revisions & Feedback Projects include up to two (2) rounds of minor revisions. Additional revisions or substantial changes outside the agreed scope are billed at our hourly rate. Feedback must be clear and provided within 5 business days unless otherwise agreed; delays may extend project timelines.

6. Timeline & Delivery Timelines are estimates and subject to timely Client feedback, content delivery, and unforeseen circumstances. We will communicate any delays promptly. Final deliverables are provided in agreed formats via secure link or our online client platform.

7. Client Responsibilities You agree to provide all necessary materials, approvals, and feedback in a timely manner and to ensure that any materials you supply do not infringe third-party rights.

8. Cancellation & Termination If you cancel after work has begun, the deposit is non-refundable. We may terminate for non-payment or material breach, retaining rights to completed work and invoicing for time expended.

9. Limitation of Liability & Disclaimers To the fullest extent permitted by law, our total liability is limited to the fees paid for the specific project. We are not liable for indirect, consequential, incidental, or punitive damages (including lost profits). Services and deliverables are provided “as is” without warranties beyond those expressly stated herein. We warrant that services will be performed in a professional, workmanlike manner consistent with industry standards. Client warrants that all materials provided do not infringe third-party rights.

10. Indemnification & Confidentiality You agree to indemnify and hold us harmless from claims arising from your misuse of deliverables, infringement in materials you provide, or violation of these Terms. Both parties agree to treat non-public information disclosed during the project as confidential and use it only for performing the services. This obligation survives termination for two (2) years.

11. Force Majeure Neither party is liable for delays or non-performance caused by events beyond reasonable control (force majeure), including acts of God, illness, pandemics, strikes, or failure of the other party to provide timely materials or approvals.

12. Governing Law These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Surry County, North Carolina.

13. Severability If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Changes to Terms We may update these Terms from time to time. Continued engagement after changes constitutes acceptance of the updated Terms.
